Overview of ICC

The Internal Complaints Committee (ICC) is formed under the POSH Act to address and resolve complaints of sexual harassment in the workplace.

1. Purpose of the ICC

  • Provide a safe and secure environment for employees.
  • Address complaints related to sexual harassment.
  • Investigate complaints and take appropriate actions.
  • Ensure confidentiality and impartiality in complaint resolution.

2. Composition of the ICC

  • Presiding Officer: Senior-level female employee.
  • At least Two Members: With expertise in handling harassment complaints or legal knowledge.
  • External Member: An expert or NGO representative.
  • HR/Administration Representative: HR team member for fair handling of complaints.

Note: At least half of the ICC members must be women, and their tenure should not exceed three years.

3. Responsibilities of the ICC

  • Receive and investigate complaints confidentially.
  • Provide recommendations based on findings.
  • Maintain records of complaints and resolutions.
  • Promote awareness about the POSH Act among employees.

4. Procedure for Filing a Complaint

  1. Submit Complaint: In writing within three months of the incident.
  2. Acknowledgment: ICC acknowledges the complaint within 7 working days.
  3. Investigation: ICC completes investigation within 90 days.
  4. Resolution: ICC provides recommendations to the organization for necessary actions.

5. Confidentiality and Protection

Confidentiality: All complaint details are kept confidential.

Protection: The ICC ensures no retaliation or victimization of the complainant.

6. Awareness Programs and Training

The organization should conduct regular POSH training sessions to educate employees about:

  • POSH Act and employee rights.
  • How to file a complaint.
  • ICC’s roles and responsibilities.
