1. Introduction

[Your Organization Name] is committed to maintaining a safe, inclusive, and respectful work environment for all employees. This POSH policy is in compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013.

2. Objective of the Policy

  • To prevent sexual harassment in the workplace.
  • To provide a framework for addressing complaints effectively and sensitively.
  • To create awareness among employees about their rights and responsibilities.

3. Scope of the Policy

This policy applies to all employees, including permanent, temporary, contractual, part-time staff, and interns, at all workplace locations.

4. Definition of Sexual Harassment

Sexual harassment includes unwelcome physical, verbal, or non-verbal conduct of a sexual nature. Examples include:

  • Physical contact and advances.
  • Demand or request for sexual favors.
  • Sexual jokes, comments, or gestures.
  • Displaying sexually explicit images.

5. Responsibilities

Organization: Ensures a harassment-free environment, confidentiality, and fair investigations.

Employees: Must report harassment, cooperate with investigations, and support the policy initiatives.

6. Internal Complaints Committee (ICC)

The ICC includes a Presiding Officer (female employee), at least two members with relevant expertise, and one external member from an NGO.

7. Procedure for Filing Complaints

  • Submit Complaint: In writing within 3 months.
  • Acknowledge: ICC will confirm receipt within 7 days.
  • Investigate: ICC will complete the investigation within 90 days.

8. Disciplinary Actions

Actions include warnings, suspension, termination, or mandatory counseling.

9. Awareness and Training

Regular training programs will be conducted to educate employees and promote a respectful work environment.
